Ask.Audio Library Pass Terms of Service

ALL SALES ARE FINAL

Refunds may be provided as detailed in the "Refunds" section of this user agreement. If you feel you are entitled to a refund, contact our support department and explain the situation - we listen carefully to all customer contact and if a refund is warranted, we will provide it to you.

PAYMENT INFORMATION

To purchase a Library Pass to Ask.Audio Online Tutorial Library you must be 18 years old at the time of purchase and appropriately complete the registration and Library Pass forms. As part of the enrolment process for your Library Pass, you will be required to submit a valid credit card and pick an Ask.Audio Library Pass package. You will be billed for the Library Pass package to Ask.Audio you select during the registration process. Your Library Pass allows access to all of Ask.Audio Online Tutorial Library™ videos and begins immediately upon approval by Ask.Audio of the above information. Ask.Audio reserves the right to refuse any subscription for any reason. This offer is void where prohibited by law. Ask.Audio may discontinue this offer at any time.

BILLING CYCLE

Upon the completion of your Initial Subscription period, you will be automatically billed for an Ask.Audio subscription at the rate and term you select when you sign up for your Subscription. The automatic billing will continue until you cancel your subscription.

HOW TO CANCEL A SUBSCRIPTION

In order to avoid any payments to Ask.Audio you must cancel your subscription prior to the end of your subscription term by logging into Ask.Audio, selecting "My Account" then "My Subscription" and clicking cancel.

REFUNDS

If you feel a refund is due to you, please contact Ask.Audio support department and request a refund. Ask.Audio will only process refund requests received within 30 days of the original billing date. Ask.Audio will not refund subscriptions that have been used within the 30 day refund period. A subscription is deemed in use if you have viewed videos in the Online Tutorial Library during the subscription term.

TERMS OF MEMBERSHIP

Your subscription and any subsequent subscriptions are governed by all of the terms and conditions on the Ask.Audio site, including but not limited to the Ask.Audio Terms of Use and Privacy Policy.

Your subscription to the Online Tutorial Library allows you to watch tutorial videos Online through your web browser only. YOU MAY NOT DOWNLOAD, MISUSE, MISAPPROPRIATE, OR LEECH VIDEOS FROM THE ONLINE TUTORIAL LIBRARY.

If you breach this clause of your user agreement, you will be subject to the following actions:

• First Offence: You will receive a written warning of your offending behaviour by email.
• Second Offence: Your account will be suspended for 24 hours
• Third Offence: Your account will be suspended for 48 hours.
• Forth Offence: Your account will be terminated.

Should your account be terminated, you will NOT receive a refund for any unused portion of our service. Upon termination, we will remove you from the billing cycle and you will not be charged your recurring fee for future months.

Additionally, you will not engage in leeching, Downloading, repurposing content, or any other activity other than viewing the Online Tutorial Library™ through a web browser or N.E.D.i on the iPhone or iPod Touch. Should you engage in such activities, Ask.Audio reserves the right to seek damages from you to the fullest extent permitted by law.

PRIVACY

All information supplied by you to Ask.Audio is subject to the Ask.Audio Privacy Policy.

LIMITATION ON LIABILITY

Ask.Audio is not responsible for any problems or technical malfunction of any network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or redemption to be received by Ask.Audio on account of technical problems or traffic congestion online or on the Internet or at any Web site, or any combination thereof including any injury or damage to entrant's or any other person's computer related to or resulting from downloading or streaming any materials consistent with this agreement or subsequent use of Ask.Audio. If, for any reason, the subscription is not capable of running online as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Ask.Audio which threatens or corrupts or adversely affects the administration, security, fairness, integrity or proper conduct of this subscription offer, Ask.Audio, reserves the right, in its sole discretion, to cancel, terminate or suspend the offer and/or any subscription. ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS OFFER MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, Ask.Audio WILL DISQUALIFY YOUR ATTEMPTED REDEMPTION AND RESERVES THE RIGHT TO SEEK DAMAGES FROM YOU TO THE FULLEST EXTENT PERMITTED BY LAW.
